ARTICLE 1 - PURPOSE The company
These general conditions of sale are concluded between the individual company "Berengere Bourdil", registered under SIRET number 52012292000041, hereinafter referred to as the "seller", and any natural or legal person wishing to make a purchase via the website berengerebourdil.fr hereinafter referred to as the “buyer”.
The acquisition of a property via the site berengerebourdil.fr implies unreserved acceptance by the buyer of these conditions of sale. These conditions of sale will prevail over any other general or specific conditions not expressly approved by the seller.

The seller reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

ARTICLE 2 - CHARACTERISTICS OF THE PRODUCTS OFFERED
The descriptions and photographs of the items sold on the site berengerebourdil.fr are as accurate and true to reality as possible. However, as this is handmade jewelry, certain lengths indicated may vary slightly.

Likewise, certain colors and shapes may present irregularities inherent to their natural character or to this method of artisanal manufacturing. The customer thus acknowledges that the photographs, descriptions or graphics accompanying and illustrating the products offered for sale on the site are indicative and non-contractual and cannot engage the seller's liability in the event of error, omission or modification.

Berengere Bourdil jewelry is guaranteed for 6 months for manufacturing defects and subject to proper use and compliance with maintenance instructions. During this warranty, according to our discretion and depending on the availability of parts, the jewelry may be repaired.
Jewelry which has been subject to misuse or treatment, non-compliance with maintenance instructions, or external intervention resulting in a modification or alteration of the initial model is not covered by the warranty. , or even an accident. Unless there is a proven manufacturing defect, only shipping costs will be the responsibility of the customer. For hygiene reasons, earrings cannot be returned or exchanged.

The repair time is two weeks from receipt of the jewelry in our workshop. However, the deadline may change depending on the activity of the workshop.

ARTICLE 3 - PRICES
The prices indicated on the site berengerebourdil.fr are prices including tax in euros or American dollars, depending on the delivery country selected by the Customer. They do not include shipping costs and not any taxes.
> The seller reserves the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the price indicated when registering the order.

ARTICLE 4 - ORDERS
The information provided by the buyer when placing the order is binding on the buyer. In the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product.

Orders are only final when they have been confirmed by payment of the price by the buyer. Any package which is unable to be delivered and returned to the sender will be redistributed at the customer's expense.
The Customer then undertakes to check the possibilities of importing the products ordered with regard to the territory of the country of delivery. In the event of an exchange or refund, customs taxes and formalities are the sole responsibility of the customer.
Once the order has been validated, the recipient undertakes to cover customs fees and all taxes relating to receipt of the package. If the recipient refuses to pay customs duties, the sender will not be able to repatriate the package for reimbursement of the order.

ARTICLE 5 - PAYMENT TERMS
The buyer makes payment by Visa bank card, Mastercard for the European zone,Paypal et stripe.

The Customer's Order can only be processed upon receipt of the transfer. If payment is not made within 15 days of the Order, the Order will be automatically canceled.

ARTICLE 6 - WITHDRAWAL AND RETURNS
Make your return request online on our platform.
Pursuant to article L.121-20-12 of the Consumer Code, the buyer has a period of fourteen days to return items that do not suit him at his own expense, against reimbursement.

This period runs from the day of receipt of the order. Any return must be reported in advance by email to: contact@berengere.fr. This right of withdrawal is exercised without penalty, with the exception of shipping and return costs.

The returned item(s) must be in new condition, not have been worn or used or have been subject to any use and in their original packaging. Otherwise, the products will neither be refunded nor taken back.

Please note that the right of withdrawal does not apply to personalized purchases (engraving type) which involve an aesthetic modification of the original jewelry.

Items sold in a duo box cannot be returned individually.
Only returns against reimbursement will be accepted. The refund will be processed within 14 days maximum.

ARTICLE 7 - DELIVERY
Depending on the shipping method chosen by the customer on the site, shipping will be:

The times indicated on the site and during the order confirmation are for informational purposes only and correspond to the average processing and delivery times of packages. These deadlines are not effective for pre-ordered items and personalized items. These announced deadlines do not take into account the disruptions encountered by carriers.

The sender is usually the one who pays the shipping costs while the recipient pays the customs duties and taxes. Duties and taxes will not be prepaid for all packages sent via this website. The recipient of the package is responsible for paying all applicable duties and taxes associated with the package.

Any reasonable delay in shipping the products will not give rise to the buyer's claim for damages or cancellation of the order.

In the event that the package is damaged on delivery, the customer will check with the carrier the condition of the items in their order and will indicate precisely on the carrier's delivery note any reservations in the event of a missing or damaged item.

ARTICLE 8 - RESPONSIBILITIES
The seller's liability cannot be implemented if the non-execution or delay in the execution of one of its obligations described in these general conditions of sale results from a case of force majeure.

As such, force majeure means any external, unpredictable and irresistible event within the meaning of article 1148 of the Civil Code.

The seller's liability cannot also be implemented in the event of disruption or total or partial strike of postal services.

ARTICLE 9 - INTELLECTUAL PROPERTY
All elements of the berengerebourdil.fr site are and remain the intellectual and exclusive property of the seller. No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site.

ARTICLE 10 - ARCHIVING/EVIDENCE
The seller will archive the purchase orders on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
The seller's computerized records will be considered by the parties as proof of communications, orders, payments and transactions between the seller and the buyer.
